6.4 Safety and security
6.4.1 We use your data to help maintain the safety, security and integrity of our services and users. This includes, for example:
6.4.1.1 Using device, location, profile, usage and other information to prevent, detect and combat fraud or unsafe activities. This may also include information from third parties. In certain cases, such incidents may lead to deactivation by means of an automated decision-making process.

7.2.1.1 For example, if you are a customer, we may share your first name, average customer rating given by Merchant, and refill locations with Merchant. If you share a Petro transaction with another customer, that customer may be told your name and may see refill location.
7.2.1.2 In order to deliver your products and services purchased on our Store from Merchants, we may be required to provide your personal data to such Merchant.
7.2.1.3 The customer/delivery recipient will also receive a receipt containing information such as a breakdown of amounts charged, your first name and the Merchant from which you got a refill.
7.2.2 At your request
7.2.2.1 This includes sharing your information with:
7.2.3 Other people at your request. For example, we may share your location with a friend at your request, or your refill information when you split charge with a friend.
7.2.4 Petros business partners. For example, if you requested a service through a partnership or promotional offering made by a third party, Petro may share your information with those third parties. 7.2.6 With the owner of Petro accounts that you may use
7.2.6.1 If you use a profile associated with another party, we may share your refill information with the owner of that profile. This occurs, for example, if you are:
7.2.6.1.1 A customer using your employer’s Petro for Business profile, or taking refills arranged through Petro
7.2.6.1.2 A customer who takes a refill arranged by a friend or under a family profile.
7.2.7 With Petro subsidiaries and affiliates
We share information with our subsidiaries and affiliates to help us provide our services or conduct data processing on our behalf. For example, Petro processes and stores information in Nigeria on behalf of its international subsidiaries and affiliates.

7.2.9.1.2 This includes sharing your information with law enforcement officials, government authorities, or other third parties as necessary to enforce our Terms and Conditions, user agreements or other policies, to protect Petro’s rights or property or the rights, safety or property of others, or in the event of a claim or dispute relating to your use of our services. If you use another person’s credit card, we may be required by law to share information with that credit card holder, including refill information.

7.2.10.1 Petro may share your information other than as described in this policy if we notify you and you consent to the sharing.

8.1 Petro warrants that:

9. INFORMATION RETENTION AND DELETION
9.1 Petro retains user profile and other information for as long as you maintain your Petro account.
9.2 Petro retains transaction, location, usage and other information for one (1) year in connection with regulatory, tax, insurance or other requirements in the places in which it operates. Petro thereafter deletes or anonymises such information in accordance with applicable laws.
9.3 Users may request deletion of their accounts at any time. Following such request, Petro deletes the information that it is not required to retain, and restricts access to or use of any information it is required to retain.
9.4 Petro requires user profile information in order to provide its services. It retains such information for as long you maintain your Petro account.
9.5 Petro retains certain information, including transaction, location, device and usage information, for a minimum of one (1) year in connection with regulatory, tax, insurance and other requirements in the places in which it operates. Once such information is no longer necessary to provide Petro services, enable customer support, to enhance the user experience or for other operational purposes, Petro takes steps to prevent access to or use of such information for any purpose other than compliance with these requirements or for purposes of safety, security and fraud prevention and detection.
9.6 You may request deletion of your account at any time through the privacy settings in the Petro app or via Petro website.
9.7 Following such a request, Petro deletes the information that it is not required to retain. In certain circumstances, Petro may be unable to delete your account, such as if there is an outstanding credit on your account or an unresolved claim or dispute. Upon resolution of the issue preventing deletion, Petro will delete your account as described above.
9.8 Petro may also retain certain information if necessary for its legitimate business interests, such as fraud prevention and enhancing users' safety and security. For example, if Petro shuts down a user's account because of unsafe behaviour or security incidents, Petro may retain certain information about that account to prevent that user from opening a new Petro account in the future.
10. INTERNATIONAL TRANSFERS
We may transfer your personal data to locations in another country, if this is permissible pursuant to applicable laws in your location. There are inherent risks in such transfers.
In the event of international transfers of your personal data, we shall put in place measures necessary to protect your data, and we shall continue to respect your legal rights pursuant to the terms of this Privacy and Cookie Notice and applicable laws in your location.

15.1 This Agreement and all provisions herein shall survive so long as, and to the extent that, Petro processes or retains your data.
15.2 We may occasionally update this policy. If we make significant changes, we will notify you of the changes through the Petro apps or through other means, such as email. To the extent permitted under applicable law, by using our services after such notice, you consent to our updates to this policy.

6 HOW WE USE YOUR PERSONAL DATA
Petro collects and uses information to enable reliable and convenient refill, delivery and other products and services. We use your personal data to operate, provide, develop and improve the products and services that we offer to you. We will provide you the ability to opt-out of our marketing schemes. We also use the information we collect:

To provide promotions or contests

Petro does not sell or share your personal information to third parties for third party direct marketing purposes.

6.1 Providing services and features
Petro uses the information we collect to provide, personalise, maintain and improve our products and services. This includes using the information to:
6.1.1 Create and update your account.
6.1.2 Verify your identity.
6.1.3 Enable refills, deliveries and other services.
6.1.4 Process or facilitate payments for those services.
6.1.5 Offer, obtain, provide or facilitate insurance or financing solutions in connection with our services.
6.1.6 Track the progress of your refill or delivery.
6.1.7 Enable features that allow you to share information with other people, such as when you refer a friend to Petro.
6.1.8 Enable features to personalise your Petro account.
6.1.9 Perform internal operations necessary to provide our services, including to troubleshoot software bugs and operational problems, to conduct data analysis, testing and research, and to monitor and analyse usage and activity trends.
6.2 Safety and security
We use your data to help maintain the safety, security and integrity of our services and users. This includes, for example:
6.2.1 Screening Merchants prior to enabling their use of our services and at subsequent intervals, including through reviews of background checks where permitted by law, to prevent use of our services by unsafe stations.
6.2.2 our real-time ID checking feature, which prompts Merchants to share a selfie before going online. This helps ensure that the Merchant using the app matches the Petro account we have on file, preventing fraud and helping to protect other users.
6.2.3 Using device, location, profile, usage and other information to prevent, detect and combat fraud or unsafe activities. This may also include information from third parties. In certain cases, such incidents may lead to deactivation by means of an automated decision-making process.
6.2.4 Using user ratings to encourage improvement by affected users, and as grounds for deactivating users with ratings below a certain minimum as may be required in their region. Calculation and deactivation may be done using an automated decision-making process.
6.3 Customer support
Petro uses the information we collect (including recordings of customer support calls after notice to you and with your consent) to assist you when you contact our customer support services, including to:
6.3.1 Direct your questions to the appropriate customer support person
6.3.2 Investigate and address your concerns
6.3.3 Monitor and improve our customer support responses
6.4 Research and development
We may use the information we collect for testing, research, analysis and product development. This allows us to improve and enhance the safety and security of our services, develop new features and products, and facilitate insurance and finance solutions in connection with our services.
6.5 Communications among users
Petro uses the information we collect to enable communications between our users. For example, a Merchant may text or call a customer to confirm a purchase or delivery partner may call a delivery recipient with information about their order.
6.6 Communications from Petro
6.6.1 Petro may use the information we collect to communicate with you about—
6.6.1.1 products, services, promotions, studies, surveys, news, updates and events.
6.6.1.2 offers based on your previous orders and your interests.
6.6.1.3 measure your interest in our products and services in order to customize your experience.
6.6.2 We may also use the information to—
6.6.2.1 improve our website, applications, products and services.
6.6.2.2 detect and protect us against error, fraud and other criminal activity
6.6.2.3 troubleshoot problems and promote a safe service
6.6.2.4 enforce our terms and conditions and managing credit risk
6.6.2.5 promote and process competitions and sweepstakes, fulfil any related awards, and serve you relevant ads and content about our services and those of our business partners.
6.6.2.6 Comply with our legal obligations, including verifying your identity where necessary.
6.6.3 We identify and use your IP address to help diagnose problems with our server, and to administer our website. Your IP address is also used to help identify you and to gather broad demographic information. We will occasionally ask you to complete optional online surveys. These surveys may ask you for contact information and demographic information (like location, local government area, age, or income level). We use this data to tailor your experience at our site, providing you with content that we think you might be interested in--and to display content according to your preferences
6.6.4 You may receive some of these communications based on your profile as a Petro Merchant.
6.7 Legal proceedings and requirements
We may use the information we collect to investigate or address claims or disputes relating to your use of Petro services, or as otherwise allowed by applicable law, or as requested by regulators, government entities and official enquiries.
7 GUIDING PRINCIPLES FOR USE OF DATA
7.1 Petro warrants that:
7.1.1 your personal data shall be processed fairly and in compliance with the law.
7.1.2 your personal data shall be processed in a transparent manner via publication of our privacy notice.
7.1.3 your personal data shall be collected only for specified, explicit and legitimate purposes.
7.1.4 your personal data collected shall be relevant and limited to what is necessary for the identified purpose.
7.1.5 your personal data shall be accurate and up to date via our self-service systems.
7.1.6 you may update your details periodically and also engage in our regular verification exercises.
7.2 We shall limit our employees or agents’ (Personnel) access to your data to those Personnel who require access your data to perform their roles and responsibilities in connection with Petro Services.
8 INFORMATION SHARING AND DISCLOSURE
8.1 Some of Petro’s products, services and features require that we share information with other users or at your request. We may also share your information with our affiliates, subsidiaries and business partners, for legal reasons or in connection with claims or disputes.
8.2 Petro may share the information we collect:
8.2.1 With other users
8.2.1.1 For example, if you are a Merchant, we may share information with your customer(s) including your name and photo; your location; average rating provided by customers; total number of refills; for how long you have been using the Petro app; contact information (depending upon applicable laws).
8.2.1.2 If you choose to complete a Merchant’s profile, we may also share any information associated with that profile, including information that you submit and compliments that past customer have submitted about you.
8.2.2 At your request
This includes sharing your information with:
8.2.2.1 Other people at your request. For example, we may share your location with a friend at your request.
8.2.2.2 Petro’s business partners. For example, if you requested a service through a partnership or promotional offering made by a third party, Petro may share your information with those third parties. This may include, for example, other apps or websites that integrate with our APIs, Petrol suppliers or services, or those with an API or service with which we integrate, or business partners with whom Petro may partner to deliver a promotion, competition or specialised service.
8.2.3 With the general public when you submit content to a public forum
We love hearing from our users, including through public forums such as Petro blogs, social media and certain features on our network. When you communicate with us via these channels, your communications may be viewable by the public.
8.2.4 With the owner of Petro accounts that you may use
If you use a profile associated with another party, we may share your refill information with the owner of that profile. This occurs, for example, if you are a Merchant using an account owned by a partner Merchant.
8.2.5 With Petro subsidiaries and affiliates
We share information with our subsidiaries and affiliates to help us provide our services or conduct data processing on our behalf. For example, Petro processes and stores information in Nigeria on behalf of its international subsidiaries and affiliates.
8.2.6 With Petro service providers and business partners
Petro may provide information to its vendors, consultants, marketing partners, research firms, and other third-party service providers or business partners. This may include, for example:
8.2.6.1.1 Payment processors and facilitators.
8.2.6.1.2 Background check providers (stations and delivery partners only).
8.2.6.1.3 Cloud storage providers.
8.2.6.1.4 Marketing partners and marketing platform providers.
8.2.6.1.5 Data analytics providers.
8.2.6.1.6 Research partners, including those performing surveys or research projects in partnership with Petro or on Petro’s behalf.
8.2.6.1.7 Vendors that assist Petro to enhance the safety and security of its apps.
8.2.6.1.8 Consultants, lawyers, accountants and other professional service providers.
8.2.6.1.9 Insurance and financing partners.
8.2.7 For legal reasons or in the event of a dispute
8.2.7.1 Petro may share your information if we believe it is required by applicable law, regulation, operating agreement, legal process or governmental request, or where the disclosure is otherwise appropriate due to safety, fraud protection, credit risk reduction, or similar concerns
8.2.7.2 This includes sharing your information with law enforcement officials, government authorities, or other third parties as necessary to enforce our Terms and Conditions, user agreements or other policies, to protect Petro’s rights or property or the rights, safety or property of others, or in the event of a claim or dispute relating to your use of our services. If you use another person’s credit card, we may be required by law to share information with that credit card holder, including refill information.
8.2.7.3 This also includes sharing your information with others in connection with, or during negotiations of, any merger, sale of company assets, consolidation or restructuring, financing, or acquisition of all or a portion of our business by or into another company.
8.2.8 With your consent
8.2.8.1 Petro may share your information other than as described in this policy if we notify you and you consent to the sharing. When we share your personal data with third parties we:
8.2.8.2 require them to agree to use your data in accordance with the terms of this Privacy and Cookie Notice, our Privacy Policy and in accordance with the law;
8.2.8.3 only permit them to process your personal data for specified purposes and in accordance with our instructions. We do not allow our third-party service providers to use your personal data for their own purposes.
9 INFORMATION RETENTION AND DELETION
9.1 Petro retains user profile and other information for as long as you maintain your Petro account.
9.2 Petro retains transaction, location, usage and other information for one (1) year in connection with regulatory, tax, insurance or other requirements in the places in which it operates. Petro thereafter deletes or anonymises such information in accordance with applicable laws.
9.3 Users may request deletion of their accounts at any time. Following such request, Petro deletes the information that it is not required to retain, and restricts access to or use of any information it is required to retain.
9.4 Petro requires user profile information in order to provide its services. It retains such information for as long you maintain your Petro account.
9.5 Petro retains certain information, including transaction, location, device and usage information, for a minimum of one (1) year in connection with regulatory, tax, insurance and other requirements in the places in which it operates. Once such information is no longer necessary to provide Petro services, enable customer support, to enhance the user experience or for other operational purposes, Petro takes steps to prevent access to or use of such information for any purpose other than compliance with these requirements or for purposes of safety, security and fraud prevention and detection.
9.6 You may request deletion of your account at any time through the privacy settings in the Petro app or via Petro website.
9.7 Following such a request, Petro deletes the information that it is not required to retain. In certain circumstances, Petro may be unable to delete your account, such as if there is an outstanding credit on your account or an unresolved claim or dispute. Upon resolution of the issue preventing deletion, Petro will delete your account as described above.
9.8 Petro may also retain certain information if necessary for its legitimate business interests, such as fraud prevention and enhancing users' safety and security. For example, if Petro shuts down a user's account because of unsafe behaviour or security incidents, Petro may retain certain information about that account to prevent that user from opening a new Petro account in the future.
10 INTERNATIONAL TRANSFERS
We may transfer your personal data to locations in another country, if this is permissible pursuant to applicable laws in your location. There are inherent risks in such transfers.
In the event of international transfers of your personal data, we shall put in place measures necessary to protect your data, and we shall continue to respect your legal rights pursuant to the terms of this Privacy and Cookie Notice and applicable laws in your location.
11 DATA SECURITY
We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed.
In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.
We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.
12 YOUR LEGAL RIGHTS
It is important that the personal data we hold about you is accurate and current. Please keep us informed if your personal data changes during your relationship with us.
Under certain circumstances, you have rights under data protection laws in relation to your personal data, including the right to access, correct or erase your personal data, object to or restrict processing of your personal data, and unsubscribe from our emails and newsletters.
13 DATA BREACH
Petro has in place procedures to deal with any suspected personal data breach and will notify affected individuals and applicable regulators where legally required to do so. If you know or suspect that a personal data breach has occurred, immediately contact support@petrostations.com
14 CONSEQUENCE OF POLICY VIOLATION
Failure to comply with this Policy is a serious compliance breach. As a Merchant, it will constitute a breach of your contract with Petro and we may review, and/or terminate, your assignment with us.
15 POLICY UPDATES
15.1 This Agreement and all provisions herein shall survive so long as, and to the extent that, Petro processes or retains your data.
15.2 We may occasionally update this policy. If we make significant changes, we will notify you of the changes through the Petro apps or through other means, such as email. To the extent permitted under applicable law, by using our services after such notice, you consent to our updates to this policy.
15.3 We encourage you to periodically review this policy for the latest information on our privacy practices. We will also make prior versions of our privacy policies available for review.
